Supplementary affidavit filed today, is taken on record.
Heard Mr. L. P. Mishra, learned counsel for the petitioner and learned Standing Counsel.
The petitioner has challenged the order dated 04.06.2010, passed by State Government whereby she has been placed under suspension on the charges of irregularities committed during the course of selection for the post of Sahayika in 2007.
Upon perusal of the record, it reveals that the irregularities, whatever were, came to knowledge of the authority in 2007 itself thereafter the Director of the Department made an inquiry and submitted a report in light of which having been found only minor irregularity she has been promoted to the post of District Programme Officer in 2009. But now in 2010 on the basis of same very charges, she has been placed under suspension. We are of the view that after so much lapse of time there is no occasion to suspend the petitioner that too after promotion to the higher post.
Therefore, we hereby, stay the order dated 04.06.2010, passed by State Government and till further order of this Court.
It is clarified that the opposite parties may make inquiry and conclude the same with the co-operation of the petitioner expeditiously.
As prayed by learned Standing Counsel, four weeks time is allowed to file counter affidavit.
