JUDGMENT / ORDER

Heard Mr. J.S. Shukla learned counsel for petitioner, learned State Counsel for opposite parties 1,2 and 3, Mr. Ranvijay Singh learned counsel for oppsoite party No.4, Mr. J.B.S. Rathour learned counsel for opposite party No.5 and Mr. Ajay Kumar for opposite party No.6.
Petition has been filed seeking following reliefs:-
"I. To issue a writ, order or direction in the nature of certiorari thereby quashing the impugned part of modified list dated 30.11.2020 related to the petitioner issued by opposite party no.4 allotment of the district on the post of Assistant Teacher in Primary School, District- Kushi Nagar as contained in Annexure No.1 to this writ petition.
II. To issue a writ, order or direction in the nature of certiorari thereby quashing the clause of 18 of affidavit which was issued by the opposite party no.6 as contained in Annexure No.2 to this writ petition.
III. To issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to allot District Sultanpur on the post of Assistant Teacher in Primary School and to conduct the counseling at District- Sultanpur, in accordance with law."
Learned counsel for petitioner submits that the petitioner was selected for the post of Assistant Teacher in the general category obtaining 69.58 marks but has been allotted district Kushi Nagar whereas another candidate namely Anupama Pandey and Bandana Mishra having secured lesser marks have been allotted district Sultanpur. It is submitted that the petitioner having secured higher marks was entitled to be posted at Kushi Nagar instead of Sultanpur. Learned counsel for petitioner further submits that even in the option given by petitioner, district Sultanpur has been opted by her at serial No.1.
Mr. Ranvijay Singh learned counsel appearing on behalf of opposite party No.4 submits that in case the petitioner submits a representation to the concerned authority, the anomaly if any, can be very well looked into and redressed by the said authority.
In view of such submission, learned counsel for petitioner submits that the petitioner may be granted liberty to approach the concerned authority for redressal of his grievance.
Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No. 4 i.e. Secretary, Board of Basic Education, Prayagraj. In case such a representation is filed, the same shall be decided by a reasoned and speaking order within with period of three weeks from the date a copy of this order is produced before the said authority With the aforesaid observations, the writ petition stands disposed of.
