The case of the petitioner is that while she was studying in standard XI at Jawahar Navodaya Vidyalaya, Rohila, Mohammadabad District Farrukhabad, she fell ill and remained confined to bed for considerable period, on account of which she could not appear in the examination. She applied for re- admission in standard XI so that her studies are not interrupted. It seems that by a communication dated 12.3.2018, the Principal of the institution has informed the District Magistrate that there is no provision for re-admission.
Prima facie, it is does not appeal to reason that a student who could not appear in the examination on account of illness or some such reason, would not be permitted to pursue his/her studies any further and such a student has to leave the institution and seek admission elsewhere. However, without expressing any final opinion on the said issue, this Court is of the opinion that interest of justice would be served in directing the District Magistrate, Farrukhabd, who is the chair-person of Jawahar Navodaya Vidyalaya, Farrukhabad to take decision in the matter.
Learned standing counsel states that the District Magistrate (respondent no.3) shall take decision in the matter within such time as may be directed by this Court.
Accordingly, instant writ petition is disposed of with direction to the third respondent to pass a speaking order on the request made by the petitioner for re-admission in standard XI in Jawahar Navodayala Vidyalaya, Farrukhabad, within a period of six weeks from the date of receipt of representation alongwith a certified copy of this order.
