Heard Mr Shahabuddin, learned counsel for the petitioner and Mr Vivek Verma, learned counsel for the respondent-Development Authority.
Having regard to the nature of prayers made in the writ petition, counsel for the respondent-Development Authority, submits that the respondent- Development Authority is prepared to consider the petitioner's application/representation dated 14.7.2017, subject to petitioner depositing non-construction charges with the respondent-Development Authority within a period of four weeks from today. Counsel for the petitioner submits that the petitioner shall deposit non-construction charges within four weeks from today. His submission is also recorded and accepted. In view thereof, we dispose of this writ petition by the following order:
The petitioner shall deposit non-construction charges with the respondent- Development Authority within four weeks from today. Thereafter, the concerned authority shall consider and decide the petitioner's application/representation dated 14.7.2017, as expeditiously as possible and preferably, within a period of eight weeks therefrom. It is made clear that this Court has not examined merits of the case.
With these observations, the petition is disposed of.
