2.0. Rule. Shri Hajare, learned advocate waives service of notice of Rule on behalf of heirs of respondent no.3- Shri Manoj J. Raval. In the facts and circumstances of the case and with the consent of the learned advocates for the respective parties, the application is taken up for final hearing.
3.0. Present application has been preferred by the applicant herein-appellant permitting him to bring the heirs and legal representatives of respondent no.3- Shri Manoj J. Raval (now deceased) on record of main Second Appeal No. 162 of 2011 as well as Civil Application No.8195 of 2011 as respondent nos. 3/1 to 3/3.
4.0. Having heard Shri Chhaya, learned advocate for the applicant and Shri Hajare, learned advocate for proposed heirs of respondent no.3 Shri Manoj J. Raval and as the application is within the period of limitation, present application is allowed and applicant is permitted to bring the heirs and legal representatives of respondent no.3- Shri Manoj J. Raval on record of main Second Appeal No. 162 of 2011 as well as Civil Application No.8195 of 2011 as respondent nos. 3/1 to 3/3. Rule is made absolute to the aforesaid extent. Registry is directed to amend the cause title of main Second Appeal as well as Civil Application.
