The prayer of the petitioner is for allotment of land/place in the premises of Krishi Utpadan Mandi Samiti Noida, District Gautam Budh Nagar and permit the petitioner to carry out its business from the premises.
The case of the petitioner is that although he has been accorded license but no place of business has been allotted and, therefore, the same be allotted.
Sri Adarsh Bhushan, who appears for the Krishi Utpadan Mandi Samiti, submits that there can be no allotment without auction. He submits that the shop/place is put for auction under 2016 Rules. The person eligible can bid in that auction. It is only after auction that place can be settled in favour of the successful bidder.
The learned counsel for the petitioner thus prays to withdraw this petition with liberty to file a fresh petition after examining the Rules, if so considered necessary.
In view of the above, the petition is dismissed as withdrawn with liberty as prayed for.
Whenever a fresh petition is filed, copy of the notice of the petition shall be served upon Sri Adarsh Bhushan, who has appeared for the Krishi Utpadan Mandi Samiti.
