Heard learned counsel for the petitioner, learned Standing Counsel and Sri Raveen Singh, Advocate, holding brief of Sri Mohan Singh, learned counsel for the respondent no.4.
This petition has been filed with the following main prayer:-
"I. issue a writ, order or direction in the nature of MANDAMUS commanding the Opposite Parties specially the opposite party no. 2 i.e. District Magistrate , Sultanpur to pass appropriate order on the complaint dated 7.12.2020 moved by the petitioner (Annexure No. 5 to the writ petition ) under Rule 3 of The U.P. Panchayat Raj (Removal of Pradhan, UP Pradhan and Members) Enquiry Rules 1997, expeditiously as early as possible within period of two weeks."
It has been submitted by learned counsel for the petitioner that several irregularities have been committed by the sitting Gram Pradhan of Village Pipari, Tehsil Baldirai, District Sultanpur, for which initially a complaint was made by other villagers and thereafter one complaint was also made by the petitioner on 07.12.2020 along with an affidavit as required under the provisions of Rule 3 of the U.P. Panchayat Raj (Removal of Pradhan, UP Pradhan and Members) Enquiry Rules, 1997, but no orders have been passed therein. The elections for the post of Gram Pradhan are going to be held very soon. Therefore, this petition has been filed.
This petition is disposed of with a direction to the respondent no.2 to consider and decide the complaint made by the petitioner by passing a reasoned and speaking order, only if the same has been filed as per the Rules of 1997, within a period of three months from the date a copy of this order is produced before him.
