Heard Shri Saroj Kumar Tiwari, learned counsel for the petitioner and learned Standing Counsel for the State - respondents.
The petitioner, in the writ petition, is seeking quashing of the order dated 10.10.2018 in so far as it relates to the cancellation of permit, bearing Permit No. UP 63/UPG/GOOD/2013/ 10874 dated 03.09.2018, in respect of the petitioner's Vehicle No. UP 64H - 5362.
It is stated that the permit of the petitioner has been cancelled due to overloading. In paragraph no. 8 of the writ petition, it is stated that the petitioner has already deposited the penalty of Rs. 31,000/- on 26.05.2018, but the challan is missing.
We cannot expect such a submission. If the petitioner wants relief in this case and is relying upon the decision of a Division Bench of this Court passed in Writ A No. 1636 of 2019, Anurag Singh Vs. State of U.P. & 2 Others, decided on 31.01.2019, he must show that he has deposited the penalty amount of Rs. 31,000/-.
In the absence of the said challan receipt, we dismiss this writ petition.
