Heard learned counsel for the applicant, the learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No. 288 of 2017, under Sections 302, 201/34 IPC and Section 4/25 Arms Act, P.S. Devarniya, District Bareilly.
As per prosecution case, no person has been nominated in the commission of the offence; on the arrest of co-accused, name of the applicant surfaced and on his pointing out, assault weapon i.e. knife has been discovered dug in the soil; postmortem examination report shows incised injury on vital part.
In this backdrop, learned Additional Government Advocate opposed the prayer for bail and submits assault weapon was discovered on the pointing out of the applicant; postmortem examination report corroborates the prosecution version.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application at this stage.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
