None appears on behalf of the applicant, though Shri Nabab Singh Chauhan, learned counsel for the opposite party is present.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 05.10.2020 passed in Writ A No. 12118 of 2020 (Deepak Sharma Vs. State of U.P. and Others).
Two affidavits of compliance were filed by Shri Nabab Singh Chauhan, on behalf of opposite party nos.1 and 2. It is stated in para 7 of the affidavit of compliance that in pursuance of the order passed by this Court a decision has already been taken by the opposite party on 12.04.2021. Copy of which is appended as annexure 1 to the affidavit, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed. However, in case applicant is still aggrieved it is open for the applicant to approach the authority concerned, if so advised.
