Heard learned counsel for the petitioner, learned Standing Counsel for respondent no.1 and Sri Chandrakesh Rai, learned counsel for respondent no.2.
The petitioner was appointed on the post of Assistant Teacher and joined Primary School Athaunda Block Babina, District Jhansi on 19.07.1997. The petitioner was thereafter transferred from the said institution to Primary School Dhimar Pura in the year 2005. The petitioner subsequently was promoted and transferred to Primary School Jaswant Pura, Jhansi in the year 2010. Petitioner at present is working in the said institution.
Due to ailment of the petitioner, he seeks transfer from the said institution to any other institution near the headquarter of district Jhansi. The petitioner in this regard has also submitted a representation to the respondent no.2 on 16.08.2018 and subsequent thereto, a number of reminder in the form of representations have also been filed, but respondent no.2 has not considered the grievance of the petitioner.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.2-District Basic Education Officer, Jhansi raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same by reasoned and speaking order within a period of three months thereafter.
With the aforesaid observations, the writ petition is disposed of.
