Supplementary affidavit filed today by the learned counsel for the applicant, is taken on record.
This is the second bail application. The first bail application was rejected on merits by this Court vide order dated 07.4.2017.
By means of this application, the applicant has prayed to release him on bail in S.T. No.612 of 2014, State Vs. Deepak & Ors, arising out of Case Crime No.731 of 2014, under Sections 302, 201 and 364A/34 I.P.C., Police Station-Chakeri, District-Kanpur Nagar.
Heard learned counsel for the applicant and learned A.G.A. Perused the record.
The only fresh ground taken in this second bail application is that despite a clear direction issued to the learned trial court to conclude the trial expeditiously, without granting any unnecessary adjournment to either of the parties, the trial is still continuing and only four prosecution witnesses have been examined till date, whereas the applicant is languishing in jail since about 4 years.
Learned A.G.A. has vehemently opposed the bail application by drawing the attention of this Court towards the statements of the witnesses available on record and has contended that there is cogent evidence against the applicant about his involvement in the heinous offence of murder for ransom of a young boy. There is no fresh ground on the basis of which the applicant can be released on bail.
No opinion can be expressed on the merits of the case at this stage. However, keeping in view the facts and circumstances of the case and the period of detention already undergone by the applicant, the trial court is directed to make all possible efforts to conclude the trial within a period of six months from the date of production of certified copy of this order.
With the aforesaid direction, the second bail application is disposed of. Order Date:-14.9.2018-SB
