Heard Sri Ram Raj Pandey, learned counsel for the applicant and Sri R.K. Maurya, learned AGA for the State.
It has been stated by learned counsel for the applicant that the offence for which correction application has been moved was not mentioned in the bail rejection order dated 05.09.2014.
The learned AGA pointed out that the said subsequent offence is added section for which separate bail application was moved on behalf of the applicant in the added offence which was too rejected by the court below. Certified copy of the same has been annexed with the correction application for which the applicant has to move fresh bail application for the added section. Hence, the present correction application is not maintainable.
The contention of the learned AGA has force therefore the present correction application is dismissed with liberty to file fresh bail application in the added sections.
Office is directed to return the free copy of the bail rejection order dated 13.10.2014 which has been annexed in the correction application to the counsel for the applicant by retaining a photo copy of the same.
