Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner, by means of the present writ petition, has assailed the transfer order dated 15.07.2021 passed by respondent no.2, by which the petitioner has been transferred from District Bijnor to Sitapur.
After arguing the matter at some length, learned counsel for the petitioner submits that he is confining his prayer only to the extent that the petitioner may be permitted to submit a comprehensive representation against the transfer order dated 15.07.2021 before the respondent no.2-Commissioner, Food Safety and Drug Administration, U.P., Lucknow and the same may be disposed of by respondent no.2 in accordance with law and in the light of the transfer policy.
Considering the aforesaid limited prayer of the learned counsel for the petitioner and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.2-Commissioner, Food Safety and Drug Administration, U.P., Lucknow along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances against his transfer within a period of two weeks from today. In case, any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same strictly in accordance with law and in the light of transfer policy, by a reasoned and speaking order, preferably within a period of two months thereafter.
For a period of three months or till disposal of representation of petitioner, whichever is earlier, transfer order dated 15.07.2021 passed by respondent no.2, so far as it relates to the petitioner, shall remain stayed.
With the observations made above, the writ petition is disposed of.
