The order of transfer dated 14th July 2019 is assailed on the ground that petitioner has only completed six years and that under the transfer policy dated 29th March 2018, petitioner could continue for a period of seven years.
Petition is opposed by learned Standing Counsel.
It is not in dispute that the petitioner holds a transferable post and transfer is an incidence of service. He has otherwise continued at the same station for more than six years. The transfer policy is not to be read as a statute and is at best directory in nature. It is always open for the appropriate authority to pass an order of transfer as per exigency. In the absence of any violation of statutory provision or malafide, no interference with the order of transfer is, therefore, called for.
Writ petition is accordingly, dismissed.
