Heard learned counsel for the applicant.
This Court in First Appeal From Order No. 3754 of 2010 has passed an order on 03.01.2011. The relevant extract of the order dated 03.01.2011 is quoted herein below:-
"With the consent of the learned counsel for the parties, the appeal is disposed of with a modification that the plaintiff respondents shall at their own expense make arrangement for the discharge of the used and dirty water from the first floor of the defendant appellant within a month.
It is made clear that the findings recorded herein shall not prejudice any of the parties in the suit."
Admittedly, the suit is pending before Civil Judge Senior Division, Jhansi. There is no material placed by which the applicant can establish that the order passed by this Court dated 03.01.2011 has not been complied with. Even otherwise the order has been passed long back on 03.01.2011 and the suit is pending, this Court directs the court below to expedite the proceedings in the pending suit and dispose of the same expeditiously and preferably within six months from the date of production of certified copy of this order.
With the above observation, the application is disposed of. Order Date :- 26.8.2019 Israr
