The present revision under Section 397/401 Cr.P.C. has been filed challenging the order dated 10.7.2019 passed by Additional Chief Judicial Magistrate/ Additional Civil Judge (Senior Division), Ghaziabad Court no.6 in Case No. 37 of 2019 (Smt. Joyti Vs. Deepak Jain & Ors) under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (for short 'Act') P.S. Loni Border, District- Ghaziabad whereby the application for grant of interim maintenance under Section 23 (2) of the Act was allowed directing the revisionist to pay lump-sum amout of Rs. 50,000/- towards interim maintenance.
The order impugned is appealable order under Section 29 of the Act. The present revision against the said order is not maintainable before this Court.
In view of above, the present revision is dismissed on the ground of alternative remedy available to him under Section 29 of the Act.
Office is directed to returned the certified copy of the impugned order within a week after retaining the photostat copy of the same on record.
