Learned counsel for the petitioner contends that the petitioner was appointed as Junior Engineer on contract basis. The service of the petitioner has been dispensed with without assigning any reason.
Learned counsel for respondent nos.2 to 4 contends that the petitioner consciously signed contract of service. The period of contract has expired and, therefore, the petitioner cannot make any grievance. The petitioner is bound by the undertaking given by him at the point in time, when he joined service under contract for a limited period. The period of contract cannot be extended by virtue of a court order.
Learned counsel for the respondent, however, admits that the case of the petitioners is similar to Civil Writ Petition No.3183(SS) of 2012, Pratul Chauhan & others v. State of U.P. & others, which is pending adjudication for 01 November, 2012.
List on 01.11.2012 alongwith Civil Writ Petition No.3183(SS) of 2012, Pratul Chauhan & others v. State of U.P. & others.
In the meantime, petitioner would be entitled to the same interim direction, as issued in Civil Writ Petition No.3183(SS) of 2012, Pratul Chauhan & others v. State of U.P. & others.
