Heard learned counsel for the revisionist, learned AGA and perused the record.
By means of the present criminal revision, the revisionist is assailing the validity and veracity of order of Juvenile Justice Board decided on 02.06.2018 by which the revisionist has been declared as major on the date of the incident and aggrieved by this order, the present criminal revision has been preferred.
Sri Mohit Singh, learned counsel for the complainant has drawn the attention of the court to Section 52 of the Juvenile Justice (Care and Protection) Act, 2000 which provides :-
"Subject to the provisions of this section, any person aggrieved by an order made by a competent authority under this Act may, within thirty days from the date of such order, prefer an appeal to the Court of Session: Provided that the Court of Session may entertain the appeal after the expiry of the said period of thirty days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time."
"वर्तरमान फौजदारी अपील स्वर्ीकार की जाती है तथा िवर्द्वान िकशोर न्याय बोडर मेरठ द्वारा पािरत आदेश िदनांकिकत 12.11.2014 अपास्त िकया जाता है I पत्रावर्ली िकशोर न्याय बोडर मेरठ को इस िनदेश के साथ िरमांकड की जाती है की वर्ह इस िनणरय मे पािरत िदशा-िनदेशों को दृष्टिष्टिगत रखते हुए दीपक की तरफ से िदए गए िकशोर अपचारी घोिषित िकये जाने के प्राथरना पत्र का िनस्तारण िवर्िधिनुसार करना सुिनित श्चत करे I उभय पक्ष िकशोर न्याय बोडर मेरठ के समक्ष िदनांकक 16.07.2015 को उपित स्थत हो I On this ground the counsel for the complainant has assailed and I have gone through Section 52 of the Juvenile Justice (Care and Protection) Act the remedies provided to the revisionist to raise his grievance before the appellate authority. Learned counsel for the revisionist has raised a juvenile proficiency that his appeal would be a time barred appeal.
Keeping in view that the appeal is pending since 18.06.2018, I hereby reject the present revision with liberty to file a separate appeal u/s 52 Juvenile Justice (Case and Protection) Act without raising the objection of the limitation and shall decide the appeal on merit of the case after hearing the parties.
