1. Short counter affidavit filed on behalf of respondents 1 and 2 is taken on record.
2. Pursuant to this Court's order dated 19.04.2019, Sri Sarvagya Ram Mishra, District Magistrate, Mathura and Sri Sushil Kumar Srivastava, Divisional Railway Manager, Agra are present before Court and filed their personal affidavits along with exemption applications, same are taken on record.
3. Respondent 2-Divisional Railway Manager, Agra stated in his personal affidavit that after issuen of notice, alternative route has been provided to villagers. Para 3 of affidavit is quoted below:
"3. That, the aforesaid PIL has been filed by the petitioner for seeking relief for providing alternate route to the villagers, which has been closed on account of newly constructed Route, Bridge over the Railway Track."
4. However, District Magistrate, Mathura stated in his affidavit that two different long routes, were proposed, due to construction, which obviously was causing inconvenience to public.
5. Since alternate route has now been provided, nothing further survives in the matter.
6. Initially we intended to impose some cost upon respondents 3 and 4 for unnecessarily causing this petition since this petty matter could have been resolved at their own end but taking a lenient view and giving warning that in petty matters they should not compel common people to unnecessary rush to the Court and should take care in future, we dispose of this writ petition as having become infructuous.
