J U D G M E N T
[Judgement of the Court was delivered by M.V.MURALIDARAN, J.] This Civil Miscellaneous Appeal arises against the judgement and decree dated 12.07.2013 passed in I.A.No.802 of 2010 in O.P.No.419 of 2010 on the file of the Principal Family Court, Chennai.
2. In a matrimonial dispute between appellant/Wife and respondent/husband, the respondent/husband has filed O.P.No.2755 of 2009 under Section 13(1) (ia) of the Hindu Marriage Act seeking dissolution of marriage that took place between both of them on 21.08.1997 on the ground of cruelty. Pending the said O.P., appellant/wife has preferred I.A.No.802 of 2010, seeking interim maintenance under Section 24 of the Hindu Marriage Act. The Court below, by impugned order dated 12.07.2013, dismissed the said I.A. Challenging the order passed in the said I.A., appellant/wife has preferred this Civil Miscellaneous Appeal.
3. The learned counsel for the respondent/husband submitted that a decree of divorce by mutual consent was granted to them by dissolving the marrige tie up between them that took place on 21.8.1997, vide order dated 06.09.2016 in O.P.No.904 of 2016.
4. Recording the above submission, this Civil Miscellaneous Appeal is closed. No costs.
