JUDGMENT / ORDER

The petitioner was appointed as Upper Primary School Assistant (UPSA for short) by the first respondent Manager with effect from 1.6.2012 in St.Sebastians High School, Kanjur. The Assistant Educational Officer declined to approve the said appointment by Ext.P2 order dated 15.10.2012. Though the Manager filed an appeal before the Deputy Director of Education, Ernakulam, the appeal was dismissed by Ext.P3 order dated 16.4.2013. The revision petition filed by the Manager before the Director of Public Instruction was also likewise dismissed by Ext.P4 order dated 6.11.2013. Aggrieved thereby the petitioner has filed Ext.P7 revision petition before the Secretary to Government, General Education Department. In this writ petition the petitioner prays for a direction to the State of Kerala to dispose of Ext.P7 revision petition within a time limit to be stipulated by this Court. 2. When the writ petition came up for admission hearing today, Sri.V.Vijulal, learned Senior Government Pleader appearing for the State of Kerala submitted that if as on today the original of Ext.P7 2 revision petition has been received by the State Government and it is pending, the Government will consider the same and take an appropriate decision thereon at the earliest.
In the light of the said submission and having regard to the fact that a revision petition lies before the Government in the matter of grant of approval of appointment, I dispose of the writ petition with a direction to the State Government to consider and pass orders on Ext.P7 revision petition, if the original thereof has been received and is pending, expeditiously and at any rate within a period of four months from the date on which the petitioner produces a copy of the judgment along with a copy of the writ petition complete in all aspects before the Secretary to Government, General Education Department. The Government shall before disposing of the revision petition issue notice to and afford the petitioner, the Manager of the school and the educational authorities concerned, an opportunity of being heard and shall after orders are passed, communicate copies thereof to all the parties.
