Heard Sri Rama Shanker Yadav, learned counsel for the applicant and Sri Prashant Kumar, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the learned Judicial Magistrate, Azamgarh to decide the Complaint Case No. 569 of 2016 (Deepa Vs. Sandeep) u/s 498-A IPC & under Section 3/4 D.P. Act, P.S. Gambheerpur, District Azamgarh expeditiously within short span of time.
Learned counsel for the applicant states that the present case u/s 498-A IPC & under Section 3/4 D.P. Act is pending since 2016 and not a single witness has been examined by the court below, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months without permitting undue adjournments to either sides, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
