The irresponsible statement is made by the counsel for the appellant that the name of the opponent Advocate is not shown. The opponent Advocate only appears if the steps are taken. Office note shows that the since 2016, steps are not taken. Hence, for making an incorrect statement also, this appeal is dismissed with exemplary cost of Rs.5,000/-.
The cost should be deposited by the Advocate himself within two weeks for making an incorrect statement. Though, he was given to examine the file, the noting is very clear that since 2016 no steps are taken.

List the matter on 13.03.2019 for order.
The order of cost shall remain stayed till then.
