Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submits that the applicant is languishing in jail since 8.6.2018, hence, the applicant may be released on bail.
Learned A.G.A. has vehemently opposed the prayer for bail contending that the applicant was enlarged on bail in 2004, on 21.3.2015 applicant absconded, proceedings under Section 82 Cr.P.C. was initiated, thereafter, the applicant surrendered on 8.6.2018; it is further urged that the trial has been pending as the applicant has not cooperated; in the circumstances; it is not in public interest to enlarge the applicant on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Deep Chand involved in Case Crime No. 290 of 2003, under Sections 302, 201 IPC, P.S. Gola, District Gorakhpur.
Accordingly, the bail application is rejected.
However, the trial court is further directed to expedite the trial of the aforesaid case and conclude the same expeditiously, preferably within four months from the date of production of a certified copy of this order, provide there is no other impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
