Heard Sri R.C. Dwivedi, learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
The order impugned in the writ petition dated 22nd December, 2011 was passed by the District Inspector of Schools, Deoria declining to grant approval to the selection of the petitioner on the Class-IV post in the Intermediate College Pindi, District-Deoria.
Learned counsel for the petitioner made several submissions on the merits of the case. However, before going into the merits of the case, the delay in approaching this Court is writ large on the face of the record. The delay is inordinate and has not been satisfactorily explained.
Considering the pleadings in the record, the delay is not only unexplained but unexplainable. Courts cannot exercise discretion in favour of litigants, who are not diligent, but sleep over their rights for long years. In this view of the matter, this Court declines to interfere with the order passed by the District Inspector of Schools on the ground of delay and laches.
Accordingly, the writ petition is dismissed.
