Admittedly an order of punishment dated 25 November, 2016 came to be inflicted upon the petitioner, in terms of which one annual increment had been stayed. The claim now laid is for grant of increment for the years 2016-17 and 2017-18.
According to the learned Standing Counsel, the increment for 2016-17 would not be payable in light of the order of punishment which has attained finality. It is, however, submitted that insofar as the increment for 2017-18 is concerned, the same shall be duly considered and disposed of by the third respondent in accordance with law.
This Court accordingly without going into the merits or otherwise of the claim of the petitioner disposes of this writ petition with a direction that it shall be open to the petitioner to represent his case before the third respondent within a period of two weeks from today alongwith a certified copy of this order and a copy of the writ petition alongwith its enclosures. The third respondent, upon making of such representation, shall duly evaluate the claim of the petitioner and dispose of the same in accordance with law within a period of two months therefrom.
