Heard learned counsel for the parties.
The instant writ petition has been filed seeking the following relief:
"issue a writ, order or direction, in the nature of mandamus directing the Commissioner, Vindhyachal Region, Mirzapur (respondent no. 2) to decide the stay application of the petitioner filed on 7.12.2018 in appeal no. 758 of 2018 (Raghunath Singh and others vs. Ram Jatan Singh and others) under Section 24(4) of U.P. Revenue Code, 2006 pending before him."
After arguing the matter at length, learned counsel for the petitioner submits that the petition may be dismissed as withdrawn with liberty to the petitioner to make an appropriate application in the pending appeal before the concerned authority to expedite the stay application.
In view thereof, the writ petition is dismissed as withdrawn with the aforesaid liberty.
