Heard the counsel for the petitioner.
The present writ petition has been filed by the petitioner praying for a writ of mandamus directing the Consolidation Officer, Kashya, District Kushi Nagar, i.e., respondent no. 1 to decide Restoration Application No. 97 dated 28.3.2019 filed under Rule 109 of the Uttar Pradesh Consolidation of Holdings Rules, 1954 pending in the court of Consolidation Officer, Kashya, District Kushi Nagar.
The Consolidation Officer, Kashya, District Kushi Nagar, i.e., respondent no. 1 is directed to decide the aforesaid application, if still pending, within a period of three months from the date a copy of this order is produced before him, in case, there is no legal impediment in deciding the aforesaid application.
It is clarified that this Court has not expressed any opinion on the merits of the claim of the petitioner.
With the aforesaid direction, the writ petition is disposed of.
