Heard learned counsel for the petitioner, learned standing counsel for respondent no.1 and Sri Santosh Kumar, learned counsel for respondent nos. 2 and 3.
The petitioner has prayed for issuance of mandamus commanding the respondent nos. 2 and 3 to take necessary action and pass appropriate order changing the government policy dated 23.2.2019 upgrading the Junior High School from English Medium to Hindi Medium.
Counsel for the petitioner has placed reliance of the contents of the order dated 23.2.2019 issued by the Secretary U.P. Basic Shiksha Prishad U.P. Prayagraj addressed to the Divisional Assistant Education Director (Basic) State of U.P. and District Basic Shiksha Adhikari of all the districts of U.P. From perusal of clause (v) it is clear that the said letter/instruction has been issued by the Secretary by which the Secretary has directed the authorities concerned that in class 1, 2 and 3 of English Medium school the medium of education will be English Language whereas in class 4, 5 and above higher classes the medium of education will be both in English and in Hindi.
Learned counsel for the petitioner, in fact, after argument at some length has himself stated that prima facie there appears no lacuna in the order passed by the Secretary.
The writ petition is therefore, dismissed.
