Heard Mr. V.K.S. Somvanshi, learned counsel for the petitioners and Mr. Kushal Kant, learned counsel for the respondent - Bank.
The only prayer made in the writ petition, reads thus:
"I) Issue a writ, order or direction in the nature of Mandamus, commanding the respondent no.2 to unlock the cold-storage in question for the ongoing current season so as to protect, preserve and prevent the produce of crops (potatoes) stored by the petitioners from perishing and further be pleased to direct the respondent no.1 not to take steps to take physical possession of the cold storage till the produce of crops (potatoes) belonging to the petitioners are kept preserved the colds-storage in question."
Though such a prayer is made, counsel for the petitioners submits that petitioners would be satisfied, if they are allowed to remove their potatoes which are stored in the cold storage in question. Counsel for respondent no.2 - Bank, submits that the Bank has already taken possession of the cold storage and if there are any potatoes belonging to petitioners stored in the cold storage, they shall allow them to remove the same within next 10 days. His statement is recorded and accepted. In view thereof, nothing further survives in the petition. Petition is disposed of.
