The contention of the learned counsel for the petitioners is that admittedly informant's daughter Diksha is an adult aged about 18 years and that she has voluntary entered into relationship with accused Narendra (petitioner no. 2).
The learned counsel for the petitioners Sri Anoop Kumar Dubey has produced Diksha (petitioner no. 1) before us she has also affirmed the aforesaid contention.
The matter requires consideration.
The learned A.G.A. has accepted notice on behalf of the respondents no. 1, 2 and 3.
Notice be issued to the respondent no. 4 fixing 3.4.2019.
List on 3rd April, 2019. By the next date, the respondents shall file their respective counter affidavits.
On the next date petitioner no. 1 shall appear in person.
Till the next date of listing or till submission of police report under Section 173(2) Cr.P.C., whichever is earlier, the petitioner shall not be arrested in Case Crime No. 23 of 2019, under Section 366 I.P.C., P.S. Katghar, District Moradabad, subject to petitioners' co-operation, in the investigation.
It is made clear that investigation of the case has not been stayed.
