ORDER:
This writ petition is filed for a Mandamus to set aside proceedings in Lr.No.AAO/ERO-V/Mint/JAO-0II/Billing/D.No.661/A/14 dated 4.12.2014 of respondent No.2, whereby he has called upon M/s. Hyderabad Builders to pay a sum of Rs.41,719/- within 15 days, failing which it was stated that action will be initiated to disconnect the link services which are being enjoyed by the members of the petitioner society.
Inasmuch as the petitioner is left with effective alternative remedies of approaching the forum for redressal of grievances of the consumers and also the Ombudsman under sub-sections (5) and (6) of Section 42 of the Electricity Act, 2003, respectively, I do not find it appropriate to entertain this writ petition for adjudication on merits.
Hence, the writ petition is disposed of, without adjudicating on merits, with liberty to the petitioner to avail the above-mentioned remedies. To facilitate the petitioner to avail such remedies, the impugned demand is kept in abeyance for a period of one month. In the meantime, the petitioner can seek appropriate interim relief before the forum.
As a sequel to the disposal of the writ petition, W.P.M.P.No.48413 of 2014 shall stand disposed of as infructuous.
