THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Mr.Sunil Choudhari, learned Counsel for the petitioner.
Taking into account, the order which this Court proposes to pass, it is not necessary to issue notice to the respondent.
2. In this writ petition, petitioner, inter alia, seeks interim custody of the minor child during Summer Vacation from 14.05.2019 to 16.06.2019.
3. When the matter was taken up today, learned counsel appearing for the petitioner submitted that he be granted liberty to move an application before the Family Court seeking interim custody of the child and the Family Court be directed to decide the aforesaid application expeditiously.
4. In view of the submission and in the facts of the case, the petition is disposed of with liberty to the petitioner to file an application before the Family Court seeking interim custody of the child during Summer Vacation.
5. Needless to state that as soon as the aforesaid application is filed, the Family Court, after affording an opportunity of hearing to both parties, shall pass an order on the aforesaid application before the office of the learned Judge closes for Summer Vacation.
Accordingly, the petition is disposed of.
