Heard learned counsel for the petitioners as well as learned A.G.A.for the State-respondents and Sri Arun Kumar Singh for the private respondent.
This writ petition has been filed praying for the following reliefs:
"(1) issue, a writ or direction in the nature of certiorari quashing the impugned First Information Report 25.8.2020 in case crime no.0094 of 2020 Under Section 498-A, 506, 406 I.P.C. and 3/4 Dowry Prohibition Act, 1961, Police Station Mahila Thana District Prayagraj. (First Information Report 25.8.2020 is marked as Annexure No.1 to this writ petition) (2) Issue, a writ or direction in the nature of mandamus directing/commanding the respondent concern not to arrest to the petitioners".
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioners want to withdraw the writ petition and therefore, it may be dismissed as withdrawn with liberty to apply for anticipatory bail/bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is dismissed as withdrawn with liberty to the petitioner to apply for anticipatory bail/ bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
