JUDGMENT / ORDER

This appeal has arisen from order dated 29.11.2010 passed by the Additional District Court, Thiruvananthapuram in O.P. (Mental Health) No. 111/2009. The second appellant herein was appointed as the Manager and guardian of the first appellant mentally ill person. The appellants have challenged the inadequacy of the amount fixed by the Court below for meeting the expenses of the first appellant, through this appeal. 2. Now, when the matter has come up for hearing, the learned counsel for the appellants has pointed out that the first appellant is no more and that certain matters relating to the amount spent by the second appellant for meeting the day today expenses of the first appellant have to be settled in the matter. Learned counsel for the second appellant has sought M.F.A. (Mental Health) No. 54 of 2011 2 for an opportunity to the second appellant to moot such claims and to get it settled before the Court below, as and when such necessity arises.
In the result, this M.F.A. is dismissed as infructuous. At the same time, the second appellant is at liberty to approach the District Court, Thiruvananthapuram, to get all the claims of the second appellant settled in the matter. With such leave to the second appellant, this M.F.A. stands dismissed.
