JUDGMENT / ORDER

Petitioners have participated in the Kerala State School Kalolsavam in the year 2013-2014. The petitioners appeared the State Level Competition by virtue of an appellate order passed by the District Level Appellate Committee. In Ext.P4 regulation, if the persons who have taken part in the State Level Competition by virtue of the appellate order unless he obtains higher marks than the first prize winner in the District Level will not be considered for the grace marks. The petitioners submit that they are entitled for grace marks as they have been denied the benefit of the regulations. The petitioners rely on the judgment of this Court in W.P.(C) No.29820/2013. The above judgment with respect to a participant, who has secured equal marks along with other W.P.(C) No.4252 of 2014 2 candidates from the District at State level and therefore, this Court held that he is eligible for equal grade. However, in this case, the petitioners have only secured lower marks to the other participants from the same District. Therefore, that judgment has no application.
In view of the stipulation in the regulation, I do not find any merit in the writ petition. Accordingly, this writ petition is dismissed. No costs.
