Heard learned counsel for the applicant and learned AGA for the State.
This application has been filed by the applicant with a prayer to quash the entire proceeding of ST No. 307 of 2021 (State Vs. Sachin Chauhan & Others) as well as Charge Sheet No. 80 of 2021 dated 01.06.2021, under Section 147, 323, 504, 506 I.P.C. & 3 (2) V Ka S.C./S.T. Act, PS Amanpur, District Kasganj pending in the Court of Executive Special Judge SC/ST (Atrocities) Act, Kasganj.
After advancing his arguments at some length, learned counsel for the applicant gave up his challenge to the impugned charge sheet No. 80 of 2021 dated 01.06.2021and made a prayer that a direction be issued to the courts below to consider and decide the bail application of the applicant expeditiously in accordance with law. He further submitted at the Bar that he is not pressing any other prayer made in the application.
In view of above, relief as prayed in the application is refused.
However, considering the prayer made by learned counsel for the applicant, it is directed that in case the applicants appears before the court concerned within 30 days from today and applies for bail, the same shall be heard and disposed of expeditiously.
With the above directions, this application is disposed of finally.
