The instant petition seeks a direction upon the second respondent to decide petitioner's representation dated 07.09.2018 which is in respect of the compensation payable to the petitioner for the land acquired from him.
On 15.11.2018, Sri Neeraj Dube, who appears for the National Highway Authority of India, was granted time to seek instructions.
Sri Neeraj Dube has produced a copy of the award dated 31.08.2018 passed by the Competent Authority/Special Land Acquisition Officer (Irrigation), Mirzapur to demonstrate that already an award has been passed.
Under the circumstances, if the petitioner is aggrieved by the quantum of the compensation awarded, he has remedy under sub-section (5) of Section 3-G of the National Highways Act. The petitioner may therefore avail alternative remedy.
With the aforesaid observation, the petition is disposed off. The copy of the award is taken on record.
