In terms of order dated 21.5.2018 in Writ-A No.12218 of 2018, the Director, Social Welfare, U.P., Lucknow was under obligation to decide the representation of the applicant regarding payment of retiral dues within two months and in case any amount is due and payable, to pay the same within a period of six weeks thereafter.
Counsel for the applicant submitted that the order of the Writ- Court alongwith fresh representation was sent to opposite party by registered post on 24.5.2018 followed by reminder dated 20.7.2018, but no decision has been taken in the matter so far nor any sum has been paid to the applicant towards retiral dues.
This Court is of the opinion that before inaction on part of the opposite party in considering the claim of the applicant is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order alongwith fresh representation before the opposite party and in which event, the opposite party shall ensure that decision in due compliance of the direction issued by the Writ-Court is taken within next four weeks. In case the decision is yet not taken, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings.
