Heard learned counsel for the petitioner, and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"a) Issue a writ, order or direction in the nature of Mandamus directing the respondent to decide the restoration application which is pending since 2013 in court of Sub Divisional Magistrate Saidpur District Ghazipur. "
The petitioner is aggrieved as his application for recall of exchange order passed in proceedings under Section 161 of the UP Zamindari Abolition & Land Reforms Act which exchange take place between the contesting respondents and the Gaon Sabha has not been decided till date.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Sub Divisional Magistrate, District Ghazipur to consider and decide the restoration application expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him.
