Heard learned Counsel for the applicant and learned AGA for the State.
The applicant seeks bail in Case Crime No. 194 of 2010 under Sections 21/22 of the N.D.P.S. Act, P.S. Fatehgarh, District-Farrukhabad.
It is contended by learned counsel for the applicant that the recovered quantity of 200 gms of Diazapam is below the commercial quantity and Sections 21/22 of N.D.P.S. Act have not been complied with. He further contended that the applicant does not have any criminal history. He further submitted that the applicant has been falsely implicated at the behest of the police.
Learned AGA also could not dispute the criminal history of the applicant under the N.D.P.S. Act.
Considering the nature of rival submissions made on behalf of the parties and the facts that the applicant does not have any criminal history, I consider it appropriate to release the applicant, Daya Shankar @ Pappu involved in case crime no. 194 of 2010 under Section 21/22 of the N.D.P.S. Act, P.S. Fatehgarh, Distt.-Farrukhabad, on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned, Order Date :- 16.6.2010 RK/-
