Heard learned counsel for the petitioner and Sri U.B. Singh, learned counsel appearing for District Administrative Committee, Jaunpur.
Petitioner claims to have superannuated from the post of Cadre Secretary under the Provisions of 'U.P. Primary Agricultural Co-Operative Credit Societies Centralised Service Rules, 1976'. He has approached this Court with the grievance that salary payable to petitioner from 1.7.2003 to 31.12.2008 has not been released to him. During this period petitioner worked worked at the Sadhan Sahkari Samiti, Nanari, Block Rampur, District Jaunpur.
Learned counsel appearing for the District Administrative Committee states that on account of amendment introduced in the Rules in 2003, liability of payment of salary seized to be of District Cooperative Bank and that salary is payable out of the funds of the society itself.
Since the petitioner is a retired employee, it would be appropriate to direct respondent no. 3 to examine petitioner's grievance relating to denial of salary for the aforesaid period, and to issue necessary directions, as may be warranted in law, after affording an opportunity of hearing to the society concerned. An appropriate decision in that regard would be taken within a period of three months from the date of presentation of certified copy of this order.All consequential action would be taken accordingly. .
