Heard learned counsel for the petitioner and Sri Ghanshyam Dwivedi, learned counsel appearing for the caveator respondent no. 2 and the learned Standing Counsel appearing for the State respondents.
Present petition has been filed for quashing the order dated 26.10.2018 passed by the respondent no. 1-Sub Divisional Magistrate, Manikpur.
At the very outset, Sri Dwivedi has raised a preliminary objection that this petition is not maintainable as the petitioner has alternative remedy by way of filing revision as provided in the Act itself.
Learned counsel for the petitioner could not dispute the same.
Present petition stands dismissed on the ground of alternative remedy. However, the petitioner is at liberty to avail the remedy as may be available to him strictly in accordance with law.
With the aforesaid observation, present petition stands dismissed.
