|

JUDGMENT / ORDER

Court No. - 38
Case :- WRIT - A No. - 58550 of 2012 Petitioner :- Daya Shankar Lal Respondent :- State Of U.P.And Others Counsel for Petitioner :- S.S.Srivastava Counsel for Respondent :- C.S.C.
Hon'ble Ran Vijai Singh,J. Hon'ble Abhinava Upadhya,J.
List has been revised. No one appears for the petitioner to press this writ petition. Learned Standing Counsel appears for the State respondents.
This writ petition has been filed with the following prayers :-
(a) Issue a writ, order or direction in the nature of mandamus directing the respondents to adjust the misc. advance of Rs. 85,596-50 P. said to be due against the petitioner.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents not to take any action against the petitioner for the notice dated 12.6.2012.
(iii) Issue a writ, order or direction in the nature of certiorari quashing the notice dated 12.6.2012.
(iv) Issue any writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
(v) To allow the writ petition and award the cost in favour of the petitioner.
Considering the nature of the relief sought by the petitioner and absence of learned counsel for the petitioner even in revised list, it appears to us that either the grievance of the petitioner has already been redressed or he is no more interested to pursue the writ petition.
The writ petition is dismissed.
However, in case, anything survives, it will be open for the petitioner to seek recall of this order.
Order Date :- 26.4.2018 Pratima
