Heard learned counsel for the petitioner and learned State Counsel.
Admittedly, there is some private dispute between the petitioner and respondent Nos. 5 to 10 relating to some landed property, in respect of which a partition suit is said to be pending before the Sub Divisional Officer concerned under Section 116 of the U.P. Revenue Code, 2006.
It the petitioner has some grievance in relation to the property which is subject matter of the suit pending before the Sub Divisional Officer, it will be open to the petitioner to approach the court concerned and in such circumstances, this writ petition would not be maintainable.
The petition is, thus, disposed of with the liberty to the petitioner to approach the Sub Divisional Officer concerned where the partition suit is pending for redressal of his grievances by moving appropriate misc. application. In case any such an application is moved by the petitioner, the same shall be considered and decided by the Sub Divisional Officer in accordance with law, with expedition.
