Heard Sri Ajai Kumar, learned counsel for the petitioner and Sri Jai Shankar Audichya, learned counsel for the respondent.
Learned counsel appearing for the respondents, at the outset, submits that the petitioner is stranger to the lis and has no locus to maintain the instant writ petition against the fifth respondent, Mahesh Chandra, an ex-service man.
The grievance of the petitioner is that the fifth respondent an OBC had got appointment by declaring himself under the unreserved category (Brahman), therefore, an enquiry be instituted against him.
On specific query, learned counsel for the petitioner submits that fifth respondent though being an OBC was appointed in service under the unreserved category, which is permissible in law.
In view thereof, the writ petition being misconceived is accordingly dismissed.
