Petitioners have approached this Court for changing the entry regarding nature of land in the Basic Tax Register. The property of the petitioners is described as ‘nilam’ in the basic Tax Register. It is also submitted that when the draft data bank has been prepared by the Local Level Monitoring Committee (LLMC) of the area, the said property is again shown as paddy land. The petitioners have a case that the said land is neither paddy land nor suitable for paddy cultivation. The remedy open to the petitioners is to approach the LLMC to make necessary changes in the said draft proclamation.
2. It is also submitted by the learned Government Pleader that the draft data bank prepared by the LLMC has already been submitted to the Government for finalisation. Apparently, if the same is finalised, probably the petitioners W.P.C.No.23094/2013 2 may not have any remedy available under the provisions of the Kerala Conservation of Paddy and Wet Land Act, 2008. Whatever that might be, it shall be open for the petitioners to approach LLMC, if the draft is not finalised and unless such changes are made, it may not be possible for the petitioners to seek correction of the entries in the basic tax register.
Having regard to the aforesaid factual situation, this writ petition is disposed of as under:
Petitioners are at liberty to approach LLMC seeking necessary corrections in the draft data bank particulars and the said application shall be considered by the LLMC in accordance with the procedure prescribed (sd/-) (A.M.SHAFFIQUE, JUDGE) jsr W.P.C.No.23094/2013 3
