Petitioner is arrayed as the second accused in crime No. 121/2014 of Kadakkavoor Police Station, Thiruvananthapuram District, registered under Sections 143, 147, 148, 149, 326, 452 and 324 of Indian Penal Code. The said crime was registered on the basis of a statement given by Mr. Saji, on the allegation that on 02.02.2014 at about 10 PM, the petitioner herein along with three others caused hurt to the defacto complainant by hitting him with an iron rode. The police arrested the first accused on 03.02.2014 and he was remanded to custody and later got enlarged on bail. Though the petitioner filed Crl.M.C.No. 659/2014 before the Sessions Court, Thiruvananthapuram seeking anticipatory bail, the same was dismissed. Later, he approached this Court by filing B.A.No. 2342/2014 seeking anticipatory bail and the same also was dismissed. According to the petitioner, he is ready to surrender before the Trial Court and co-operate with the trial, but, his apprehension is that his bail Crl.M.C.. No. 2494/2014 2 application would not be considered by the Trial Court on the day of surrender itself. Hence, he has filed this Crl.M.C. seeking the order directing the Magistrate Court to consider and pass appropriate orders on his bail application on the day of surrender itself. 2. Heard the learned counsel for the petitioner and the learned Public Prosecutor for respondent.

Considering the facts and circumstances of the case, this Crl.M.C. is disposed of directing the petitioner to surrender before the Judicial First Class Magistrate Court, Varkala, within two weeks from today and the Magistrate Court is further directed to consider and pass appropriate orders on the bail application filed by the petitioner on the same day itself, in accordance with law.
Crl.M.C. is disposed of.
