THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT R-3 TO CONSIDER THE REPRESENTATION ANNEX-E DATED 19.3.2016 AND TAKE NECESSARY STEPS TO PROVIDE THE BASIC INFRASTRUCTURES, FURNITURES AND FIXTURES AS PRAYED FOR IN THE SAID REPRESENTATION TO THE "SAMAGARA HARALAYYA COMMUNITY HALL" CONSTRUCTED AS BASAVA BUDDHA BHEEMANAGAR, DAVANAGERE AND ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Vishwajith Shetty S., learned counsel for the petitioner.
Sri.Y.D.Harsha, learned Additional Government Advocate for the respondents.
2. The petition is admitted for hearing. With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia seeks for a direction to the respondent No.3 to consider the representation Annexure-E dated 19.3.2016 and take necessary steps to provide the basic infrastructures, furnitures and fixtures as prayed for in the said representation to the "Samagara Haralayya Community Hall" constructed as Basava Buddha Bheemanagar, Davanagere.
4. After hearing the learned counsel for the parties and in view of the facts of the case, I deem it appropriate to dispose of the petition with a direction that suitable action, if not already taken on the representation submitted by the petitioner, shall be taken in accordance with law by the competent authority by a speaking order within four months from the date of receipt of certified copy of the order passed today. It is made clear that this Court has not expressed any opinion on the merits.
Accordingly, the petition is disposed of.
